HANNIBAL, Mo. — The man who is accused of beat a Vidor man to death after a fight broke out at a Hardee's in Missouri is charged with first degree involuntary manslaughter.

Damien Fugate, 33, was originally charged with second degree assault stemming from the fight at the fast food restaurant in Hannibal, Missouri on the afternoon of Sunday, March 24. Hannibal police initially responded to the Hardee's, located at 2900 James Road, for a reported assault at 3:38 p.m.

Greg Stanley, 43, of Vidor, died of his injuries at Blessing Hospital in Quincy, Missouri three days later on Wednesday, March 27.

The person who called police said a man was being verbally abusive to both employees and customers at the business, the local ABC affiliate KHQA reported. A probable cause statement obtained by the local NBC affiliate, WGEM, indicates Stanley was belligerent and shoved a Hardee's manager.

The affidavit said then Damien X. Fugate then hit Stanley, knocking him to the ground. Police arrested Fugate after the fight. Stanley was taken to Hannibal Regional Hospital and later transferred to Blessing Hospital for further treatment.

""The only thing that kept him alive was the ventilator," Stanley's sister-in-law Crystal McKee said. "According to the police report, he didn't stop, he didn't diffuse the situation, he hit him and he knew he was out but he continued."

McKee said her brother-in-law was pronounced brain dead on Monday before he was taken off life support Wednesday, March 27.

Fugate's arraignment is scheduled for April 5, KHQA said.
