Port Neches man found not guilty in sexual assault of a child case

A Port Neches man who was charged with aggravated sexual assault of a child, a first degree felony, has been found not guilty.

A jury Wednesday decided that there was not enough evidence to convict Christopher James Stone, 32, of sexually assaulted a disabled seven-year-old boy.

Officers say Stone knew the victim and the victim's mother.  They say he sneaked into the boy's bedroom and physically assaulted him in January 2013.

The jury began deliberating around 1:20 p.m. and returned a verdict at 5 p.m. The alleged victim's mother sobbed and tried to leave the courtroom when the not guilty verdict was read.  The defendant Christopher Stone also burst into tears.

During the trial the jury heard testimony from the boy who is the alleged victim, his mother and a nurse who examined the boy. The defense also called three witnesses.

Defense attorney James Macon said he believes there was a lack of evidence throughout the trial's testimony, mainly from the nurse who examined the boy.

"There were discrepancies in facts told, there were discrepancies in DNA evidence and issues with the exam we felt proved one way rather than the other," Macon said.

Stone is still in custody since he was on parole at the time of his arrest and had recently been released on mandatory supervision. Macon said Stone was on parole for alcohol related issues.

Judge John Stevens took time after the verdict was read to lecture Stone about his alcohol abuse and finishing his education. Judge Stevens also emphasized to Stone that the details of the trial were disturbing and told Stone he's fortunate the jury took time to consider factual evidence.
