Judge preparing order to remove BISD board of trustees

Posted:
12News has confirmed that 172nd District Court Judge Donald Floyd has an order prepared that would remove the Beaumont Independent School District Board of Trustees.

The order has been prepared, but at 1:30 p.m. Monday an assistant to Judge Floyd told 12News the order will not be signed today at the request of attorneys representing the plaintiffs.  The sticking point is that the board of managers has not yet been named.

Judge Floyd is currently inquiring with the Texas Education Agency about the names of a new Board of Managers which will replace the existing school board.

Sarah Langlois, representing BISD said "I haven't had an opportunity to see the order. The last time I checked with the court there had not been a signed order. I have no idea, if anything, has been entered."

12News spoke with BISD Superintendent Timothy Chargois, Ed.D early Monday afternoon.

"I would like to leave it up to my attorneys for comment. I haven't actually seen the ruling," said Chargois.

BISD spokesperson Jessie Haynes released a statement shortly after learning of Judge Floyd's decision.

"Whatever you feel about BISD, there is no reason you should tell voters you voted for these people but you don't know how to vote," said Haynes.

"People died for the right to vote. It's in vain if you live in Beaumont, Texas," said Haynes.

Once signed, the order requires school board members to appear and answer his order by 10 a.m. on the Monday following the 20th day after they have been served.

This is a developing story.  Check back for updates.
