District Attorney to decide if teen driver should face charges in fatal collision

The Texas Department of Public Safety has completed its investigation following a fatal collision that claimed the life of a Heubert Browning, 94, of Silsbee.

DPS trooper Stephanie Davis said due to circumstances surrounding the crash, the DPS has submitted the crash report to the Tyler County District Attorney's office for review. After review, the case will be presented to a Grand Jury to determine if an indictment will be handed up.

The accident happened May 3 on FM 92 near Fred in Tyler County.

According to Trooper Davis, a 2001 Buick passenger vehicle was southbound on FM 92 in front of a 1999 Acura passenger vehicle driven by 17-year-old Michelle Whitmire. Troopers say Whitmire was distracted by something inside the vehicle when she slammed into the back of the buick.

The collision injured two others. Lydia Browning, 84, of Silsbee, was the driver of the Buick when she was taken to Tyler County hospital in Woodville with minor injuries. One of the passengers in the Buick, Jeffery McGallion, 55, of Silsbee, was also taken to Tyler County hospital in Woodville with minor injuries.

Whitmire, of Spurger, received minor injuries and was not taken to the hospital.
