Man charged with murder in 2013 infant death

JASPER COUNTY - A Jasper County grand jury handed up a murder indictment this week against a man charged in the 2013 death of a three-month-old boy.

Justin Dewayne Havard, 23, was arrested November 2013 and charged with one count of injury to a child.  In February he was indicted on one count of injury to a child and one count of reckless conduct.  The grand jury this week increased the charge to murder.

The Jasper Police Department received a 911 call from Havard on November 8, 2013. He told officers that he was watching his girlfriend's 4-year-old daughter and her 3-month-old son at the Myrtis Village apartment complex.

"He said that the baby was choking, and that he was in the process of giving the baby CPR," Jasper Police Chief Robert MacDonald told 12News shortly after the incident.

MacDonald said the baby was rushed to a local hospital, where staff members realized something was wrong. The baby was then airlifted to Children's Memorial Hermann Hospital in Houston, where he died.

Autopsy results show that the baby died from severe blunt force trauma to the head.

According to 12News file stories, the baby's 4-year-old sister was removed from the home by the Department of Family and Protective Services.

The name of the child has not been released.
