Calvin Walker to get $200,000 of $2.7 million seized in 2012

Beaumont electrician Calvin Walker will receive $200,000 in funds seized from him amid criminal charges, but he will not get back the $2.7 million in forfeited funds he was seeking.

Federal Magistrate Judge Keith F. Giblin Tuesday also ruled that $661,000 owed in 2008-2010 taxes will be forgiven per a previous plea agreement.

12News spoke with Walker's attorney Dick DeGuerin shortly after the judge's ruling.  We asked him to talk about the judge's order.

"It gets the I.R.S. out of his hair forever, and number two it is clear that there was no fraud on BISD.  BISD says they weren't defrauded. They were just trying to get a piece of the pie," said DeGuerin.

DeGuerin said Walker will not be appealing Tuesday's decision.

Walker was originally accused of over billing the Beaumont Independent School District by nearly $4 million. He was indicted on 37 counts of fraud. Those charges were eventually dropped as part of a plea deal.

Under the plea deal reached in 2012, Walker pleaded guilty to one misdemeanor charge of failure to pay taxes in a timely manner. He admitted that he did not pay taxes on a $1.5 million check he received from BISD.

The district has not sought to recover funds from Walker, but sought to get $343,000 of the funds that were forfeited.  The judge denied BISD's request to get forfeited funds based on the district's claim that it is not a victim and that it was satisfied with the services provided by Walker.
