Candidate for judge responds to probated suspensions

Posted: Updated:

A candidate for Jefferson County Court at Law #3 Judge says suspensions on his record are settled and behind him.

The suspensions on Audwin Samuel's record were fully probated meaning he was still able to practice law.

The first suspension happened in 2004 for violation of the Texas Disciplinary Rules of Professional Conduct.

Documents state Samuel was paid past, present and future attorney fees.

Instead of putting some of the money into a trust account he placed it all into his personal bank account.

The second probated suspension came last year for professional misconduct in 2008.

Records say Samuel failed to reschedule a child custody hearing and he failed to notify his client or appear for her at a later date.

The court later awarded the clients ex-husband more than $6,500.

Samuel told 12News Thursday "It's public record. It was an issue with clients. They were solved with settlements. I completed it and it's over. I'm moving forward."

12News also looked up Samuel's opponent in the May run-off, Terrance Holmes and the Republican candidate for County Court at Law #3, Clint Woods.

Neither showed any public disciplinary history.  Samuel faces Holmes in a May 27th runoff for the Democratic nomination.

Samuel is currently a Beaumont City Councilman. He violated his 2004 probated suspension after defaulting on student loans. But the State Bar of Texas says he took care of that issue quickly and was only suspended from practicing law for 15 days in 2005.
