BISD electrical contractor threatens legal action against TEA

Beaumont Independent School District's electrical contractor Calvin Walker is threatening legal action against the Texas Education Agency.  His attorney Dick DeGuerin plans to contact the agency's attorneys about the contents of the preliminary investigative report on the district's finances.

In the report, the superintendent and the school board are criticized for not protecting the district against "the dishonest dealings of a vendor, namely Calvin Walker."

The report goes on to say that "the United States District Court for the Eastern District of Texas found Mr. Walker guilty of tax evasion".

DeGuerin says that's not true, he says court documents show his client pleaded guilty to a misdemeanor offense of failure to timely pay a tax owed for 2009, not tax evasion.

Walker is also fighting a battle with another state agency.  The Texas Department of Licensing and Regulation wants Walker's master electrician's license and his electrical contractor's license revoked.

The state already lost one round when Chief Administrative Law Judge Cathleen Parsley ruled in Walker's favor.

She found that Walker's federal misdemeanor criminal offense is not directly related to the occupation of licensed electricians, and that the criminal conduct did not included fraud or theft.

So Judge Parsley recommended not revoking his licenses, and allowing him to renew.  The judge also ruled it's not necessary to take any disciplinary action against Walker.

The final say will come from the Texas Commission of Licensing and Regulation.

Walker's case will go before the commission on April 2.
