Kelvin Lee Roy was taken into custody around 12:30 p.m. Sunday on a warrant out of Jefferson County for possession of marijuana.

Roy remains in the jail on a $250 bond. A jail intake officer told 12News that Roy is on a mental hold and that a psychiatrist will interview him Monday morning after he made suicidal comments.

The jail intake officer said Roy can not be released until he is examined.

Vidor Police Chief Dave Shows told 12News that no arrest warrant has been issued at this time from Orange County. Investigators are still gathering evidence to support a warrant.

A spokesperson for the Vidor Police Department said Roy was driving a white Mercury Sable that collided with a Honda minivan carrying Alexandria Bertrand Friday night.

The minivan was stopped at the intersection of South Main Street and Old Highway 90. Bertrand was sitting in the back seat, her mother was driving. According to Police Chief Shows there was evidence found at the scene that Roy may have been intoxicated.

According to a background check, Roy was convicted of DWI in 2002 in Hardin County.  In 2004 he was convicted of possession of a controlled substance which is a 2nd degree felony From 2006 to 2012 he was convicted four different times for possession of marijuana. During that time frame he was also convicted of delivery of marijuana more than a quarter ounce but less than five pounds, a state jail felony. In October of 2012 he was convicted in the assault of a family member.
