Southeast Texas blogger files lawsuit against district judge; claims civil rights violated


A southeast Texas political blogger has filed a lawsuit against a district judge and an attorney.

Philip Klein accuses 252nd District Judge Layne Walker of violating his civil rights by retaliating against Klein for publishing critical stories about the judge.

Klein claims Walker appointed Bryan, TX attorney Shane Phelps as a special prosecutor to pursue an indictment against Klein, alleging Klein tampered with witnesses in the case of Steve Hartman.

Hartman was arrested in May when he tried to serve Judge Walker with a separate lawsuit in court, an incident that Klein has also blogged extensively about on his website, www.setpoliticalreview.com.

Hartman works for Klein's private investigation's firm.

Klein accuses Walker and Phelps of violating his first amendment right to report corruption.

In addition to the lawsuit, Klein has also filed for an injunction to stop Judge Walker and Phelps from seeking the indictment against him.

Attempts to reach Judge Walker for comment on the lawsuit were not immediately returned. We did reach Phelps but he refused to comment.
