Military Judge Denies Nidal Hasan's Defense Strategy

Posted: Updated:

KCEN -- A military judge has denied the defense strategy of the accused Fort Hood shooter.

The judge presiding over the case of Nidal Hasan, Col. Tara Osborn, ruled on Friday that no one on Fort Hood posed an immediate or imminent threat in Afghanistan.

Hasan claims he was protecting the Taliban when he allegedly opened fire on post back in November of 2009 and wanted to use the defense of others strategy at trial. As the judge gave her ruling, Hasan interrupted her saying he rejecting her decision and wanted that on the record.

During Friday's court proceedings, Judge Osborn also excused two of Hasan's paralegals, but they will not be officially dismissed until replacements are found.

The judge has ordered Hasan's standby council to submit reports on what they think their role should be in this case by 12 P.M. on Monday, June 17.

The next pretrial hearing is scheduled for Tuesday, June 18.
