Jury selection expected today in manslaughter trial following death of mother and child

Jury selection is set for Monday in the manslaughter trial of a man accused of driving drunk and causing a collision which killed Alyssa Holtzclaw, 30, and her 10-month-old son Jacob Tucker Holtzclaw, both of Sour Lake.

Ines Legarda, 40,  faces two charges of manslaughter.

According to 12News file stories, Holtzclaw was traveling east on Highway 105 near Pine Island Bayou on January 16, 2011.  A driver, later identified as Legarda, was traveling west in a pickup.  He crossed over into her lane and struck her SUV.

Police say Legarda fled the scene on foot but was arrested at a home in Winnie.

The accident happened around 6 a.m. on a Sunday as Holtzclaw was on her way to drop her son off at her grandparents house before she went to Christus Hospital Saint Elizabeth in Beaumont where she worked as an X-Ray Technician.

Holtzclaw is survived by her husband and two other children. 

Perry Thomas, Jefferson County District Attorney's Office Chief of Criminal District Court, told 12News by phone that if found guilty, Legarda faces from 2 to 20 years in prison and up to a $10,000 fine on each manslaughter charge.

Jury selection is set to begin after lunch.  Mr. Thomas said there is a possibility the trial could be re-set, but if it proceeds, testimony should begin Tuesday morning.
