U.S. Attorney General files for injunction against BISD board candidates

Tuesday at 9:25 p.m., the U.S. Department of Justice filed for an injunction preventing candidates Mike Neil, Marcelino Rodriguez, Donna Forgas and Linda Gilmore from trying to have U.S. District Judge Ron Clark order that the Beaumont Independent School District elections take place in May, contrary to what a Washington, D.C. court had ordered.

The motion was filed by U.S. Attorney General Eric Holder and Assistant Attorney General for the Civil Rights Division, Thomas Perez.

On April 9, a Washington, D.C. federal judge concluded that the voting changes at issue, which include conducting elections on May 11 and the 2013 redistricting plan, would violate a portion of the Voting Rights Act.

The judge called for a temporary restraining order on these issues until judicial preclearance was obtained.

But the next day, attorneys for the BISD candidates filed for an order from the U.S. District Court for the Eastern District of Texas that would implement the voting changes Attorney General Holder had objected to.  They claim those changes do not violate the Voting Rights Act.

Holder, in his motion, disagrees,  He calls the action by the board candidates a "collateral attack and an unwarranted challenge" on the D.C. court's jurisdiction.
