Court denies delay in BISD election

The Ninth District Court of Appeals has rejected an emergency relief request by the Beaumont Independent School District that would have delayed the May 11 election.

On Tuesday, the Beaumont Independent School District requested emergency relief asking the court to "stay" its order of March 18 in which the court directed that the May 11 election be conducted using the redistricting map adopted February 21, and that the district accept applications of Marcelino Rodriguez, Donna forgas and Linda Gilmore to be on the ballot and to certify them as unopposed.  The district wanted a delay until an appeal coud be made.

The court ruling issued Wednesday says there is no evidence it should delay the election pending approval of the redistricting map by the U.S. Department of Justice.

The Order of the Ninth Court of Appeals says, "BISD has not suggested, either in this proceeding or in a related proceeding, that the Department of Justice has expressed any objection to that map"

According to our News Partner the Beaumont Enterprise, BISD attorney Melody Chappell said the request to the Ninth Court to delay the election was a step the district wanted to take toward submitting an appeal to the Texas Supreme Court.

The district also filed a request for a judgment on Tuesday to the District of Columbia Circuit Court that considers cases involving redrawn voting lines, also known as "preclearance."

Meanwhile Beaumont voter Paul Jones filed a lawsuit Wednesday against BISD seeking to delay the May election. He claims the district has not yet obtained preclearance of the new district maps as required by Federal Law.
