Children of couple killed in Thanksgiving pileup file civil suit

The children of a couple killed in the massive Interstate 10 pileup on Thanksgiving Day filed a civil suit in Jefferson County Thursday.

Vincent Leggio Jr., Richard Leggio and Amanda Machowicz are suing the owner of the 18-wheeler , C.R. England, INC, that they say collided into the back of their parents SUV. Vincent Leggio, Sr., and Debra Leggio were both killed in the accident.

Their children are also suing Richard Fernando Kerr, the driver of the 18 wheeler, and Tamika Francois and Cathryn Stegmoyer. There is no mention as to why Francois or Stegmoyer are named in the suit.

The Leggios contend Kerr was traveling at an unsafe speed when he struck the SUV driven by the Leggio couple. Their SUV was stopped on the highway as a result of numerous other accidents in front of them.

The children are seeking unspecified damages to cover their parents' funeral expenses as well as mental anguish, loss of companionship and financial losses as a result of their deaths.

The children are being represented by Beaumont attorney Walter Umphrey and the Houston firm Jamail and Kolius.

It is filed in the 60th Judicial Court in Jefferson County
