Jury seated in capital murder trial

Testimony is set to begin 9 a.m. Tuesday in the capital murder trial of 18-year-old Labyron Warren.

Warren is charged in the shooting death of Van's Grocery store clerk, Dang Nguyen, on August 1, 2010.

Investigators say Warren robbed, then shot and killed Nguyen at the store, located on Avenue A in Beaumont.

A jury of 8 women and 4 men were seated Monday afternoon.

Before jury selection, Warren told Judge John Stevens that he did not want to accept a plea deal. If he had, he would have received a 40-year-sentence for murder.  Now, Warren faces a jury on capital murder charges. If found guilty, he will automatically receive a life sentence.

Two family members were in the courtroom for Warren on Monday. No family or friends of the victim were there.

During jury selection, Warren's mother made eye contact with her son multiple times; one time holding back her tears.

Warren never made eye contact with jurors.

The prosecution says they have 19 to 20 witnesses that they will call to the stand this week.

Warren was a juvenile at the time of the shooting but signed court documents stating he wanted to be tried as an adult.

Three other adults are accused of taking part in the robbery and shooting.  They will also go on trial on charges related to the fatal robbery. Warren is accused of pulling the trigger.
