Only 2 remain defendants in excessive force lawsuit

Former Beaumont police officer David Todd Burke and current officer Cody Guedry are the only two names now listed on a civil lawsuit that accuses the officers of using excessive force on a Beaumont man during an arrest.

US District Court Judge Ron Clark has ruled in a summary judgement that officers Charles Duchamp, Jason Torres, and John David Brown should be released from the suit.

Port Arthur attorney Langston Adams filed the suit on behalf of Derrick Newman.  He is the man at the center of "excessive force" trials against Burke and Guedry.  Both were convicted on official oppression charges.

Adams argues Newman's constitutional rights were violated.

Clark ruled that the officers were pre-occupied with suspects aside from Newman, and had no time to react.

Other defendants were previously released from the suit.
