Charges upgraded to capital murder for child's death

Update 5:51: A Hardin County Grand Jury says there is enough evidence to support capital murder charges against 34-year-old Jason Delacerda and 30-year-old Amanda Guidry in the death of Guidry's 4-year-old daughter.

Hardin County District Attorney David Sheffield says he is seeking the death penalty against Guidry's boyfriend, Delacerda. Sheffield says no bond will be set for Guidry or Delacerda since the charges have been upgraded.

Sheffield says the evidence they have collected so far about 4-year-old Breonna Loftin's death is worthy of the death penalty.

"We're going to seek the death penalty in this case because justice for the sadistic torture and death of this child demands it," said Sheffield.

He says they are still investigating to see if they will pursue the death penalty for her mother.

"When you see what was done to an innocent child, who does not deserve any maltreatment, to see the nature of the torture and injuries and stuff, it does strike you down to your core," said Sheffield.

Delacerda admitted to abusing Loftin at their Kountze home. According to an autopsy, the little girl died from blunt force trauma to the head. Guidry admitted to seeing the abuse that occurred over the last three months of her daughter's life and failed to report it.

When the 4-year-old arrived to the hospital Aug. 17, an arrest affidavit says she had burns, bruises and broken bones all over her body, both past and present.

Sheffield says he should be ready to take the case to trial in a couple of months.

The charges against the couple were originally injury to a child causing serious bodily injury before being upgraded. Guidry and Delacerda have both been appointed attorneys. Jimmy Hamm is representing Guidry. Sonny Cribbs is representing Delacerda.

The Hardin County grand jury this morning heard new evidence against Jason Delacerda, 34, and Amanda Guidry, 30, both of Kountze,  before handing up the new indictments. Both are accused in the death of Guidry ‘s 4-year-old daughter Breonna Loftin.

Hardin County District Attorney David Sheffield says he is seeking the death penalty for Delacerda, but still hasn't decided whether or not to seek the death penalty for Amanda Guidry.

A jail spokesperson Tuesday morning said Delacerda and Guidry are held in lieu of bond. Delacerda's bond is $2 Million and Guidry's bond is $1.5 million bond.  

According to 12NewsNow.Com file stories, Loftin died at a hospital August 17.  An autopsy shows she died from blunt force trauma to the head. 

Arrest affidavits say Delacerda admits to abusing the child. Guidry admits to seeing some of it happen and not reporting it.
