Orange officials vote to appeal Capt. Robert Arnold's reinstatement

A majority vote was taken as Orange city council members voted to appeal an arbitrator's ruling to let Police Captian Robert Arnold back on the force.

It was a vote 5 to 1.

District 4 Councilwoman Annette Pernell was the council member to vote "no".

Pernell says the Texas Rangers, a grand jury, and the arbitrator found that he didn't do anything criminally wrong.

She believes the appeal will do no good.

PREVIOUSLY REPORTED: Orange city council members voted today to appeal an arbitrator's ruling to give Police Captain Robert Arnold his job back.

An arbitrator released a ruling last week stating that Arnold should be placed back on the force and receive back pay.

Arnold was indefinitely suspended from the force following a confrontation in the parking lot of the O'reilly Auto Parts store last July, that resulted in Arnold fatally shooting store customer James Whitehead.

The arbitrator says Arnold's due process rights were denied by the city.
