A Port Arthur Independent School District teacher who was found not guilty of injury to a child says she is appealing the school board's decision not to renew her contract.

Ruby Gunner, 63, told 12News she will ask for a hearing.

The school board only needed three votes in favor of not renewing ruby gunner's contract, and Tuesday night those votes came from Board President Lloyd Marie Johnson and trustees Dianne Brown and Greg Flores.

Vice President Thomas Kinlaw and Trustees Robert Reid and Tracy Thomas abstained from voting.  They are the same trustees Who voted not to terminate Gunner At a January 23 meeting.

Earlier this month a Jefferson County jury foundGunner not guilty of injury to a child.  A student at Robert E. Lee Elementary, DeShawn Willis had accused her of attacking him.

She said she was just acting in self-defense after the 11-year-old kicked her in the stomach.
