Mistrial declared when child porn charges against lead investigator surface

A mistrial has been declared in the trial of a man accused of aggravated sexual assault of a child after prosecutors learned that one of the lead investigators in the case is the subject of a federal investigation.

The mistrial was declared Wednesday in the trial of Toby Langham of Beaumont.

Revelations about child pornography charges against Hardin County Sheriff's Office Sergeant Jerry Roberts, who was the lead investigator, were brought to light only after a jury had been seated and opening statements in Langham's trial were about to begin.

A District Attorney's Office spokesperson said the law requires charges against Langham to be dropped due to the charges made against Roberts.

The District Attorney's Office said the DA is still pursuing four other charges against Langham. Those charges include two counts of indecency with a child and two charges of sexual performance of a child.

According to 12News file stories, charges against Langham were filed in 2010 following an incident in which he and a Lumberton woman allegedly engaged in a sex act with a 15-year-old girl.
