Orange County man gets 5 years for posession of child porn

A 20-year-old Orange County man accused of possessing child pornography was sentenced to 5 years in prison and fined $1,000.

A 20-year-old Orange County man accused of possessing child pornography was sentenced to 5 years in prison and fined $1,000. 

Prosecutors say Devon Christopher Smith was found with pornographic images on his computer in the summer of 2015. Smith, through his attorney, requested that he receive no more than probation but Judge Courtney Arkeen of the 128th District Court declined, She told Smith she put a lot of thought into the case, including the defendant's age. The maximum sentence was 10 years in jail. 

Smith was 18 when he was arrested and a presentence report stated that Smith was likely to sexually abuse a child in the future. He admitted to abusing drugs or alcohol since he was 13 and watching pornography since he was 12.

Under the terms of the sentence, Smith will have to register as a sexual offender. He has 30 days to appeal his sentence.
