Defense rests in Orange County dismemberment, murder trial

Posted: Updated: July 28, 2010 03:32 PM CDT
Closing arguments are set for Thursday in the murder trial of a Deweyville man accused of killing a Bridge City woman and later dismembering her body.

42-year-old James Edward Holden is accused of capital murder in the death of Theresa Darlene Foskey, 28, of Bridge City. Foskey was killed in 1995 at her mobile home in The Bayou Shadows Trailer Park in Bridge City and her body was later taken to Deweyville where it was dumped into the Sabine River.

The prosecution called forensic specialists to testify, including Jody Koehler with the Department of Public Safety crime lab. Koehler testified that seminal fluid at the crime scene matched Holden's, but that there was no other evidence linking his presence.

DNA tests were run on clothing from the victim and the defendant. No matches were made to Holden.

Other tests were run on several samples of items from the crime scenes, including blood stains on the carpet and walls, the iron used to strike the victim, dirt, leaves, rocks around the trailer home, and swabbings from the air conditioning vent. None of the tests showed Holden's DNA or fingerprints.

The only DNA evidence linking Holden to the scene was a positive match of his seminal fluid.

In a voluntary statement given to police the day after Foskey was reported missing, Holden admitted he drove the victim home and had intimate relations with her.

Jimmy Schroder with the Texas Rangers also took the stand. He worked on the case reviewing photographs and videos taken of the trailer and land near the Sabine River.

Schroder said in photographs of Holden taken just days after Foskey went missing, he saw no scratches, cuts, scrapes or other visible wounds on Holden's body.

After the prosecution rested, Holden's mother Nancy Sue Holden was the first witness to be called by the defense. Holden has remained emotionless in the trial, but showed a slight smile when his mother was called to testify.

Tuesday's testimony in support of the prosecution also surrounded testimony from forensic specialists detailing autopsy results and other evidence found at the scene, noting the positive test of seminal fluid.

Just a few days after Foskey was reported missing in September of 1995, her legs, arms, torso and head were found scattered near the Sabine River.

Family and friends of both the victim and the defendant told 12 News HD they will not speak on camera until the trial is over.
